Terms of Service

1. The agreement

These terms are an agreement between you and Dark Forest Enterprises LLC, a California limited liability company that operates PropFOMO ("PropFOMO," "we," "us"). By creating an account or buying a list, you agree to them.

2. What PropFOMO is

PropFOMO sells mailing lists of property records drawn from public records. Lists include property addresses, owner names, and owner mailing addresses. They do not include phone numbers or email addresses. PropFOMO is not a brokerage, MLS, lender, or legal or financial adviser. Lists are research leads, not offers, listings, or advice.

3. Your account

You need an account to buy a list, join PropFOMO Pro, or apply to be listed. Keep your sign-in secure. You are responsible for activity on your account. You must be 18 or older.

4. Buying a list

• The price, the number of records, and where the list will be delivered are shown before you pay.
• The price covers the number of records shown at checkout. A record can arrive blank if it is no longer available or an owner asked to be left out.
• Each order is delivered once, to every destination you chose at checkout (a CSV download, your Google Sheet, or your Follow Up Boss account).
• If a delivery fails, you can try again at no charge, up to 3 attempts. After a completed download, you get one more free retry if your browser did not save the file.
• Save your file. After that, a current copy of the same list is a new order.
• Delivered lists are non-refundable. A list that was never delivered, including an order that failed all 3 delivery attempts, is refunded on request.

5. PropFOMO Pro

• Pro is a monthly membership billed by Stripe until you cancel. Pro's price and benefits are shown at checkout and on your Account page. Introductory offers are described at checkout.
• The included list counts as used once it is delivered. Canceling or rejoining does not grant another included list.
• Cancel anytime from Account. Pro stays active until the end of the period you paid for. Membership fees are not refunded for partial months.
• If you cancel, lists you own stay in your account with their receipts. Describing your own lists, the member price, an unused included list, and new shares stop.
• We may change the price with at least 30 days' notice. The change applies to your next billing period.

6. Using a list

• You may use a list for your own lawful real estate business.
• You may share a list with people working on your behalf, such as an agent, an acquisitions specialist, or an outreach helper. You remain responsible for how they use it.
• You may not resell, publish, or redistribute a list, or use it to build a competing data product.
• You are responsible for following the laws that apply to contacting owners, including mail, telemarketing, Do Not Call, and state solicitation laws.
• Do not use PropFOMO to harass anyone, or to scrape or automate access to the service.

7. Local professionals directory

• Listed professionals are independent people who work owner lists, such as licensed agents, acquisitions specialists, and outreach help. They are not PropFOMO employees or agents.
• PropFOMO reviews profiles before listing them and checks agent license numbers by hand. Listing someone is not an endorsement or a guarantee of their work or results.
• Terms, pay, and the work itself are between the Pro and the listed professional. PropFOMO is not a party to that arrangement and takes no fee from it.
• A listed professional's name, role, markets, short description, email, and phone are visible to Pros.
• A listed professional may only use a list shared with them to work on behalf of the Pro who shared it, and must follow section 6.
• We may hide a profile that is inaccurate or misused.

8. Data accuracy and results

Public records can be incomplete or out of date. We do not guarantee the accuracy of any record, value, equity estimate, or ownership detail, or that any list will lead to a response or a deal. Verify before you act.

9. Connected services

Google Sheets, Follow Up Boss, and Stripe are governed by their own terms. You can disconnect a service from Account at any time. PropFOMO's use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements. It only creates and writes the sheets you choose.

10. Ending service

You can stop using PropFOMO at any time. We may suspend or close an account that breaks these terms. Sections 6, 8, 11, and 12 survive.

11. Disclaimers and limits

PropFOMO is provided "as is." To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim.

12. Law and disputes

California law governs these terms. Disputes go to the state or federal courts in Los Angeles County, California.

13. Changes

We will post changes here and update the date above. Material changes are emailed to account holders before they take effect.
